TERMS & CONDITIONS

By enrolling in classes, purchasing any membership, package, trial, event, or service, or by participating in any activity offered by Shinkai Dojo NYC, LLC (“Shinkai Dojo,” “the Dojo,” “we,” “us”), you (“Client,” “Member,” “Parent/Guardian,” or “Participant”) acknowledge that you have read, understood, and agreed to the following Terms & Conditions.
These Terms & Conditions constitute a legally binding agreement between you and Shinkai Dojo NYC, LLC.
1. PAYMENT POLICY — FINAL SALE
All payments made to Shinkai Dojo NYC, LLC are final.
All purchases are:
Non-refundable
Non-transferable
Not eligible for credit, rollover, or substitution
This policy applies to all offerings, including but not limited to:
Monthly memberships
Registration and enrollment fees
Trial packages
Workshops, camps, clinics, and special events
Parents’ Night Out
Exams, evaluations, and retests
Founding Family contributions
Merchandise, uniforms, and equipment
Any recurring or one-time charge
No refunds, credits, or reversals will be issued for reasons including, but not limited to:
Missed classes or absences
Scheduling conflicts
Travel, vacations, or illness
Weather-related closures
Behavioral removals or suspensions
Early withdrawal or non-participation
Failure to attend or fully utilize services
Payment reflects access and availability, not attendance or outcomes.
2. RECURRING MEMBERSHIPS & BILLING AUTHORIZATION
All monthly memberships are billed on a recurring basis until properly canceled.
By enrolling in a recurring membership, you authorize Shinkai Dojo NYC, LLC to:
Charge the payment method on file automatically
Continue billing until cancellation is completed by the client
Clients are solely responsible for:
Managing their membership
Updating payment information
Canceling prior to the next billing cycle
Failure to cancel before a billing date does not qualify for refunds, credits, or reversals.
Declined or failed payments must be resolved promptly. Unresolved balances may result in:
Suspension of training access
Account restriction
Denial of future enrollment
3. MEMBERSHIP STRUCTURE & USAGE
Memberships provide access based on the program, frequency, and level selected.
Key clarifications:
There are no 1x-per-week memberships
Attendance allowances are defined by membership tier
Make-up classes are permitted within the same billing month only
Unused classes do not roll over to future months
Attendance is subject to instructor discretion to ensure safety, pacing, and student readiness
Memberships grant training access, not guarantees of advancement, rank promotion, or class placement.
4. REGISTRATION & ENROLLMENT FEES
All students must maintain an active annual registration fee.
Registration fees:
Are administrative in nature
Are non-refundable once processed
Include onboarding materials as applicable
Do not constitute tuition
Do not guarantee specific class times, instructors, or placement
Failure to maintain an active registration may result in suspension of training eligibility.
5. TRIAL PACKAGES
Trial packages are offered on a limited basis and are subject to strict conditions.
Trial packages:
Are for new students only
Must be used within the stated validity period
Are limited to the number of classes specified
May not be applied to invite-only or advanced programs
Are non-refundable under all circumstances
The Dojo reserves the right to cancel trial bookings that exceed permitted use.
6. FOUNDING FAMILY PROGRAM
Founding Family contributions are one-time, honorary household contributions made in support of the establishment and long-term growth of Shinkai Dojo.
Founding Family contributions:
Are one-time and non-refundable
Apply to one household and are non-transferable
Do not replace tuition, memberships, or registration fees
Do not guarantee perpetual pricing or enrollment
Founding Family recognition:
Includes permanent name placement on the Shinkai Dojo Founders Wall
Includes Founding Family recognition within the dojo
Remains in effect for the lifetime of the Shinkai Dojo program
Founding Family recognition benefits:
A 10% recognition rate applies to Shinkai Dojo core karate programming
Applies only while at least one household member maintains an active Shinkai Dojo karate membership
Applies to:
Standard belt examinations (excluding Black Belt testing)
Shinkai Dojo karate memberships
Summer and holiday workshops
Parent’s Night Out programs
Birthday celebrations hosted by the dojo
Private instruction related to the Shinkai Dojo karate program
Exclusions:
Recognition does not apply to:
Black Belt testing
External events
Tangible goods such as uniforms, t-shirts, snacks, water, or merchandise
Separate programs outside the Shinkai Dojo karate program
Additional notes:
Recognition is permanent
Pricing-related recognition applies only while the account remains active
Benefits are subject to program availability and scheduling
7. SCHEDULING, INSTRUCTORS & OPERATIONS
Shinkai Dojo does not guarantee:
Specific class schedules
Specific instructors
Continuous availability of programs
Preferred class times
Immediate advancement or placement
Schedules and offerings may change due to:
Staffing needs
Safety considerations
Attendance levels
Facility or operational requirements
No refunds or credits are issued due to schedule changes.
8. ASSUMPTION OF RISK
Martial arts training involves inherent physical risks, including but not limited to:
Bruising
Strains or sprains
Joint or muscle injuries
Falls or collisions
Accidental contact with equipment or participants
Participation is voluntary. By enrolling, you assume all risks associated with training.
Shinkai Dojo NYC, LLC, its owners, instructors, employees, and contractors are not liable for:
Injury
Medical expenses
Property damage
Loss of income
Any damages arising from participation
This provision supplements any separately executed liability waiver.
9. MEDICAL DISCLOSURE
Parents/guardians are responsible for disclosing all relevant:
Medical conditions
Allergies
Physical limitations
Behavioral considerations
The Dojo is not responsible for injuries or complications resulting from undisclosed conditions.
In emergencies, staff may contact emergency services at their discretion. Associated costs are the responsibility of the participant or guardian.
10. CONDUCT & REMOVAL POLICY
Shinkai Dojo reserves the right to suspend or remove any student or family for:
Unsafe behavior
Disrespectful conduct
Disruption of class
Noncompliance with policies
Nonpayment
Conduct by students or parents/guardians that undermines the training environment
Removal does not entitle the client to refunds or credits.
11. PHOTOGRAPHY & MEDIA RELEASE
By attending classes or events, you grant permission for the Dojo to use photographs or video recordings for:
Marketing
Promotional materials
Social media
Website content
No personal identifying information will be shared. Written requests for exclusion may be submitted.
12. CHARGEBACKS & DISPUTES
All chargebacks will be disputed using available documentation, including:
Signed agreements
Digital acceptance records
Attendance logs
Payment confirmations
Service availability records
Accounts associated with disputed charges may be suspended or terminated.
13. GOVERNING LAW
This agreement is governed by the laws of:
The State of New York
The County of New York
Any legal action must be brought exclusively in New York County, New York.
14. ELECTRONIC CONSENT
Digital acceptance, checkbox confirmation, or participation constitutes:
Legal agreement
Electronic signature
Authorization for billing
Acknowledgment of all Terms & Conditions
FINAL NOTE (IMPORTANT)
Enrollment at Shinkai Dojo is a privilege, not an entitlement.
Participation signifies agreement with all policies herein.
